In short

• Feeling Yachty S.A. runs this site. The boat and the crew for each charter are provided by the Charter Provider named in your confirmation.
• A charter booked here is paid in two parts: the crew and fuel online, the boat balance at the dock.
• If you cancel a charter, the fuel charge is kept as the deposit and the rest of what you paid online is refunded.
• These terms are governed by the laws of Panama.

The company behind the site is described on who we are at Feeling Yachty, and the rules for the day of a charter are in the charter terms.

1. Definitions

“Feeling Yachty”, “we” and “us” mean Feeling Yachty S.A., a company incorporated in the Republic of Panama and the holding company for the Feeling Yachty brand. “You” means anyone using the site. A “Network Partner” is a business or person in the Feeling Yachty network, such as a charter operator, yacht owner, captain, crew, marina or shore vendor, or payment partner. A “Charter Provider” is the Network Partner that owns, operates, captains or crews the vessel for a booking. A “Payment Partner” processes or collects payments made through the site. A “Listing” is any boat, product, service or offer shown on the site.

2. Use of the site

Use the site only for lawful purposes. Do not infringe the rights of others, interfere with how the site works, try to gain unauthorised access, introduce malicious code, scrape the site without permission, or misuse its forms, messaging or checkout.

3. Who runs the site

Feeling Yachty S.A. operates the site. Listings, the running of each charter and the processing of payments may be handled by Network Partners as these terms describe.

4. Intellectual property

The text, graphics, logos, photos, videos, designs and software on the site, and the trademarks and domain names, are owned by or licensed to Feeling Yachty S.A. Using, copying, changing or distributing them without written permission is not allowed. Photos and descriptions supplied by Network Partners remain theirs and are used with permission.

5. What you send us

Anything you submit, such as a booking request, message, review or file, may be used by us and the Network Partners involved to run the services, answer you and coordinate your request, and, where you have agreed, to send you marketing. You confirm that what you send is accurate, lawful and not infringing, and you remain responsible for it.

6. Listings

We work to keep descriptions, photos, availability and prices accurate, but we do not promise that every Listing is complete, current or free of errors. Content may be corrected, updated or removed at any time, including after a request is made, as far as the law allows.

7. Payments

Payments are processed by Payment Partners, which receive the money for the benefit of the Charter Provider and other Network Partners involved. For a charter booked through the site’s checkout, the crew and fuel are charged online to confirm the booking, higher-priced boats also take a deposit online that comes off the balance, and the boat balance is paid at the dock by cash or Zelle. Add-ons ordered without a boat are paid in full at checkout. Pay-later plans are offered by their own providers on eligible bookings.

The Charter Provider is responsible for the vessel, its condition, the crew, safety, permits, insurance and the running of the charter. Nothing in these terms creates a partnership, joint venture, employment, agency or fiduciary relationship between us and any Network Partner or user.

8. Cancellations, refunds and weather

If you cancel a charter booked through the site, the fuel charge is kept as the deposit and the rest of what you paid online is refunded to the original payment method. If the captain, the marina or the authorities stop a departure for safety, the charter is rescheduled or credited. The full rules, including late arrival and no-shows, are in the charter terms. Refunds go back through the same Payment Partner and method used to pay, subject to its processing times.

9. Our role

Feeling Yachty S.A. is a holding company and a brand and technology operator. The site is a platform for finding, booking and coordinating charters and services: we route requests, relay messages, help with scheduling and confirm details. Each vessel is owned and operated by the Charter Provider named in your confirmation, which may be a company in the Feeling Yachty group or an independent owner or operator. Network Partners are not our subsidiaries unless stated, and cannot bind us without our written authority. You waive any claim that we or a Payment Partner act as your fiduciary, agent or broker.

10. No warranties

The site, its content and its Listings are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a purpose, seaworthiness, availability, accuracy or non-infringement.

11. Limitation of liability

As far as the law allows, Feeling Yachty S.A., its officers, directors, employees, contractors and Payment Partners are not liable for any direct, indirect, incidental, consequential, punitive or special damages arising from the use of the site or services, reliance on Listings, the acts or omissions of Network Partners, Charter Providers, captains or crew, the condition, operation or safety of any vessel, or disputes between you and a Network Partner.

12. Indemnification

You agree to indemnify and hold harmless Feeling Yachty S.A., its affiliates, officers, directors, employees, contractors and Payment Partners against claims, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your use of the site or services, your part in any charter, your dealings with Network Partners, or your breach of these terms or the law.

13. Links to other sites

The site may link to other websites and services. We are not responsible for their content, availability or practices, and you visit them at your own risk.

14. Ending access

We may suspend or end your access at any time, without notice, if we believe your conduct breaks these terms or puts us, other users, Network Partners or the site at risk.

15. Governing law and disputes

These terms, and any dispute about the site, the services, Listings, payments, messages, charters, cancellations, refunds, chargebacks or Network Partners, are governed by the laws of the Republic of Panama, without regard to conflict-of-law rules. Any dispute is brought and resolved only in Panama City, Republic of Panama, and the parties submit to the exclusive jurisdiction of its competent courts. As far as the law allows, you waive any jury trial and bring claims only individually, not as part of a class, collective or representative action. We may seek injunctive relief in the Panama City courts to protect our intellectual property, confidential information or the site.

16. Changes

We may update these terms at any time. The date at the top shows when they last changed, and using the site after a change means you accept the updated terms.

18. SMS and text messages

If you give a phone number and opt in, at checkout, by subscribing or by texting a keyword, you agree to receive recurring text messages: reminders, booking confirmations and updates, and promotions and offers. Consent is not a condition of purchase. Message and data rates may apply and frequency varies. Reply STOP to opt out at any time, or HELP for help, or email team@feelingyachty.com. Numbers and messages are used as described in the Feeling Yachty privacy policy and are not shared with third parties for marketing without your consent. Text messaging is meant for United States numbers and may not work elsewhere.
