Who We Are at Feeling Yachty

Effective date: 23 April 2025.

In short

  • We collect what you give us to answer and book a charter, plus basic device and usage data.
  • We share booking details with the captain, crew and partners who run your charter, and payment details only with the payment provider.
  • We do not store full card numbers.
  • You can ask to see, correct or delete your data, and opt out of marketing at any time.

Feeling Yachty is part of the company described on who we are at Feeling Yachty; the full policy follows.

1. Who we are

Feeling Yachty S.A. operates as a holding company and brand and technology operator. Through the site we provide concierge coordination and booking services that may connect you with independent partners in our network (each a “Network Partner”): yacht owners, charter operators, captains, crews and other service providers (each a “Charter Provider”), and payment processors (each a “Payment Partner”).

2. Information we collect

Information you provide. Contact details (name, email, phone, messaging handles); booking details (date, time, boat, guest count, extras, special requests); account details if you create an account; messages, emails, chat and support requests; and anything you submit, such as a review or a signed charter agreement.

Information collected automatically. Device and usage data such as IP address, browser, device identifiers, pages viewed, referring URL, approximate location and timestamps, and the technologies described in section 5.

Payment information. Card payments are processed by our Payment Partner, and pay-later plans by the provider you choose at checkout. We do not store full card numbers or card authentication data on our servers; each Payment Partner processes them under its own privacy practices.

3. How we use information

  • To provide and operate the site and the services.
  • To respond to enquiries and route requests to the right Network Partner or Charter Provider.
  • To coordinate bookings, logistics, confirmations, updates and support.
  • To process, or facilitate the processing of, payments.
  • To remember your preferences and personalise the site.
  • To send transactional messages such as confirmations and charter updates.
  • To send marketing messages where permitted, with an opt-out.
  • To detect, prevent and investigate fraud, abuse, security incidents and illegal activity.
  • To comply with legal obligations and enforce our terms.

4. Legal bases

Where the law requires one, we process personal information on the basis of your consent (for example marketing or SMS opt-in), the performance of a contract or steps before one (responding to a booking request), our legitimate interests (site security, analytics, fraud prevention, service improvement), or compliance with a legal obligation.

5. Cookies and similar technologies

The site uses a session cookie to keep you signed in to your account, browser storage that remembers the boats you have saved and the filters you have chosen, and analytics that record how the site is used. You can control cookies and storage in your browser; disabling them may stop the account and the saved-boats list from working.

6. Embedded content

Pages may embed content from other sites, such as maps and videos. Embedded content behaves as if you had visited the other site, which may collect data, set cookies and track your interaction with it.

7. Who we share information with

Network Partners and Charter Providers. When you ask for availability, a quote or a booking, we share the details needed to provide it: your name, contact details, date and time, boat, guest count and special requests.

Payment Partners. When you pay, the identifiers and transaction details needed to take the payment and reconcile it (amount, currency, booking reference) go to the Payment Partner. We do not control its privacy practices.

Service providers. Vendors that help us run the business (hosting, analytics, CRM, email and SMS delivery, customer support, spam detection), under confidentiality obligations.

Legal and safety. To comply with law, respond to lawful requests, enforce our agreements, protect our rights, investigate fraud or security issues, or protect users and the public.

Business transfers. As part of a merger, acquisition, financing, reorganisation or sale of assets, subject to appropriate protections.

8. International transfers

We are based in Panama. Your information may be processed in Panama and in other countries where our service providers, Network Partners, Charter Providers or Payment Partners operate, which may have different data protection laws from yours. By using the site you understand that your information may be transferred and processed internationally.

9. Data retention

We keep personal information for as long as reasonably necessary for the purposes in this policy: to provide the services, keep records, resolve disputes, enforce agreements and comply with the law. Account information is kept while the account is active and afterwards as needed for legal and security reasons; enquiries and bookings are kept as needed for operations, support, accounting, fraud prevention and legal compliance.

10. Your rights and choices

Depending on where you live, you may have the right to access a copy of the personal data we hold about you, to correct it, to have it deleted subject to legal exceptions, to object to or restrict certain processing, and to receive an export of certain data. You can opt out of marketing email with the unsubscribe link or by contacting us; transactional messages such as booking updates may still be sent. To make a request, contact us as in section 16. We may need to verify your identity first.

11. SMS and text messaging

If you opt in to SMS we may send booking messages (confirmations, updates) and, where you consent, promotional messages. Message and data rates may apply and frequency varies. Reply STOP to opt out at any time and HELP for help. SMS is delivered through a third-party messaging provider and may be limited or unavailable outside the United States.

12. Data security

We use reasonable administrative, technical and physical safeguards to protect personal information. No system is completely secure and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for using secure devices and networks.

13. Children

The site and the services are not intended for anyone under 18 and we do not knowingly collect personal information from children. If you believe a child has given us personal information, contact us and we will take appropriate steps.

14. Governing law and venue

This policy is governed by the laws of the Republic of Panama. Any dispute, claim or controversy arising out of or relating to this policy or our privacy and data practices shall be brought and resolved exclusively in Panama City, Republic of Panama, and the parties submit to the exclusive jurisdiction and venue of the competent courts there.

15. Changes

We may update this policy at any time. The effective date at the top says when it last changed, and continued use of the site after a change is acceptance of the revised policy.

16. Contact

Questions and requests about this policy go to team@feelingyachty.com or through contact Feeling Yachty. The terms for using the site are the Feeling Yachty terms of service, and the terms of a booking are the yacht charter terms.
