Yacht Charter Terms

These charter terms apply to every yacht charter booked through Feeling Yachty: what the price includes, how the crew and fuel are paid online and the boat balance at the dock, what happens if you cancel or the weather turns, arrival and timing on the day, safety and conduct on board, and how disputes are resolved.

Terms of Service

Last updated: 29 October 2026. By paying for a charter through the checkout you accept these terms.

The essentials

  • The price on each boat is the whole charter: the boat, a licensed captain and crew, and fuel.
  • Crew and fuel are paid online to confirm; the boat balance is paid at the dock by cash or Zelle.
  • Cancel and the fuel charge is kept as the deposit; the rest of what you paid online is refunded.
  • Charters run rain or shine. If the captain, the marina or the authorities stop a departure for safety, it is rescheduled or credited.
  • Arrive 20 to 30 minutes before departure. The charter starts at the booked time.

These sit alongside the Feeling Yachty terms of service, which cover the use of the site itself.

1. Who we are

Feeling Yachty, a company incorporated in the Republic of Panama, runs an online marketplace and concierge service where yacht owners and operators, including companies in the Feeling Yachty group, offer charters and on-water experiences. Feeling Yachty coordinates and schedules the booking; the Charter Provider named in your confirmation provides the vessel and crew. Payments for vessel hire made on the platform are processed by Miami Yacht Nautical Charters LLC, the payment processor. Some data storage and processing is provided by Cyber Locker Switzerland S.A. Messages and coordination from the team are information, not legal, tax, insurance or seamanship advice.

2. Who can book

The person booking must be 18 or over, or the age of majority where it is higher, and able to enter a contract, and may be asked for a government ID at boarding. You confirm that the names, the guest count, including children, and the contact and payment details you give are accurate, and that you are booking for your own group and will not sell seats.

3. What you pay, and when

The price shown for a boat and a number of hours is the whole charter: the boat, a licensed captain and crew, and fuel. To confirm the booking, the crew and fuel are charged online; on higher-priced boats a deposit is also taken online and comes off the balance. The boat balance is paid at the dock on the day by cash or Zelle. Add-ons are paid as the checkout shows. Pay-later plans such as Klarna, Affirm and PayPal Pay Later are offered by their providers on eligible charters, as set out under payment and financing options. A refundable security hold may apply on some boats; your confirmation says so if it does.

4. Cancelling

If you cancel, the fuel charge is kept as the deposit and the rest of what you paid online is refunded to the original payment method. Close to departure, cancel or change through the team rather than your account. A no-show, a late arrival or leaving early is not a cancellation and is not refunded.

5. Weather

Charters run rain or shine: light or moderate rain, passing showers, heat, sea breeze and chop are normal in South Florida and are not grounds for a refund or a chargeback. If the captain, the marina, PortMiami or the U.S. Coast Guard decides conditions are unsafe, or an authority closes the water, the charter is rescheduled or credited.

6. Changing the date or time

Ask the team as early as you can. A new date or start time depends on the yacht and crew being free, and on marina and port rules; it is never guaranteed, and a holiday date may be priced differently.

7. On the day

Arrive 20 to 30 minutes before departure for parking, check-in and the safety briefing, and come together if you can. The charter starts at the booked time, not when the group arrives, and a late arrival does not move the end time. Many boats have another charter after yours, so the end time is fixed unless the captain agrees to extend; overtime, if the yacht is free and the marina allows it, is agreed with the captain at the hourly rate before it starts. If the group has not boarded by the time the captain can no longer wait without affecting the next charter, the booking is treated as a no-show.

8. Captain, crew and guest numbers

Every charter booked here comes with a licensed captain and crew. The captain is responsible for safe navigation and may change the route, limit speed, anchoring or swimming, or end the trip early for safety or legal reasons. Each yacht carries no more guests than its certification allows, as shown on its page; children count toward the limit. A booking is for one group and seats may not be sold individually.

9. Safety and conduct

Boating carries risks, including motion, wakes, slips, sun and heat, dehydration and seasickness; you are responsible for your own fitness to take part and for bringing what you need, such as medication, sunscreen and a hat. Illegal drugs, weapons, fireworks, glass on deck unless the captain allows it, and commercial filming without permission are not allowed. The captain may refuse boarding or end the charter for intoxication or unsafe behaviour, without a refund. Adults are responsible for the minors in their group, who must follow the life jacket rules. Pets come aboard only where the boat allows them, and extra cleaning or damage may be charged. The full rules are on yacht safety protocols.

10. Damage and other charges

You authorise the charges for the balance, taxes, any approved overtime, gratuities you choose, and damage, loss or extraordinary cleaning caused by your group, which a security hold may be applied to. Please raise any problem with the team rather than filing a chargeback; disputes follow section 14.

11. The boat on the day

Specifications, photos and features are supplied by the owner and may vary slightly on the day for maintenance or safety. A comparable vessel may be substituted to complete the charter; if a mechanical fault or crew illness stops it, the charter is rescheduled or credited.

12. Insurance, IDs and waivers

The vessel is insured by its owner or operator; you may ask the captain for proof. Travel or medical insurance is your choice and responsibility. A government ID and a signed waiver or charter agreement may be required to board.

13. Messages and records

You agree to receive booking emails and texts: confirmations, coordination, reminders and follow-ups. We keep a record of when you accepted these terms and which version, and electronic records and signatures count as originals. Your data is handled as the privacy policy describes.

14. Disputes

Before bringing a claim, write to team@feelingyachty.com and allow 30 days for an answer. Except for small claims and injunctions, any dispute about these terms or the platform and concierge services is settled by binding individual arbitration at the Centro de Conciliación y Arbitraje de la Cámara de Comercio, Industrias y Agricultura de Panamá (CCIAP), seated in Panama City; hearings may be held by video, and the arbitrator decides questions of arbitrability. There are no class, collective or representative actions. These terms are governed by the laws of the Republic of Panama, without waiving consumer protections your own country does not allow to be waived. Court matters, such as injunctions or enforcing an award, go to the courts of Panama City. Each side bears its own costs unless a claim is frivolous or in bad faith. A claim must be brought within six months of arising. If a chargeback is filed for something these terms cover and is reversed, you are liable for the processing fees and USD 250 in administrative costs. Where a dispute is heard in court, you waive a jury trial. The English text controls over any translation.

15. Limit of liability

As far as the law allows, Feeling Yachty’s total liability for the platform and concierge services is limited to the lesser of USD 500 or the platform fees it kept for your booking, and Feeling Yachty is not liable for indirect, incidental, special, punitive or consequential damages, lost profits, business interruption, data loss or loss of goodwill.

16. Indemnity

You agree to defend, indemnify and hold harmless Feeling Yachty, its affiliates and their officers, directors, employees and agents against claims, losses and expenses, including reasonable legal fees, arising from your breach of these terms, your breach of the law or of anyone’s rights, what your group does on board, at the marina or in transit, or information you provide.

17. General

Neither Feeling Yachty nor the owner is liable for delays or cancellations caused by events beyond reasonable control, such as severe weather, port closures, orders of an authority or mechanical failure despite reasonable maintenance; the remedy is a reschedule or credit where possible. If a provision is found unenforceable, the rest stays in force, and not enforcing a provision is not a waiver of it. You may not transfer your booking without written consent; Feeling Yachty may assign these terms to an affiliate or in a merger or sale. Headings are for convenience. These terms, the listing details and any accepted addenda are the whole agreement about the platform and concierge services. We may update these terms; the date at the top shows the version in force when you book.
